Terms of Use

For the Novara IPTV Player apps and the website novaraiptv.com, including the provider information (imprint).

This is a translation for convenience. In case of discrepancies, the German version prevails.

1. Provider (imprint)

The provider of the Novara IPTV Player apps and the website novaraiptv.com (service provider under § 5 of the Austrian E-Commerce Act, ECG) is:

Code by MKUngargasse 1451030 Wien, AustriaEmail: support@novaraiptv.com

2. Scope

These terms of use apply to the Novara IPTV Player apps for Android TV, Google TV and Fire TV and for Android smartphones and tablets (together “the apps”) and to the website novaraiptv.com. By installing or using the apps, you agree to these terms. If you download the apps from an app store, its terms also apply.

3. Service

Novara is a media player. The apps contain no content of their own: we do not provide channels, movies, series, playlists or login details.

To play content, you need your own sources, for example an M3U playlist or an Xtream Codes or Stalker account from your IPTV provider. The respective provider, not us, is responsible for the selection, availability, quality and lawfulness of this content.

We continuously develop the apps and may change, add or discontinue features. Some features rely on third-party services (see the privacy policy); we cannot guarantee that they are always available.

4. License

We grant you a simple, non-transferable right to use the apps for private purposes. All other rights to the apps, the website and the Novara name and logo remain with us.

5. Your obligations

When using the apps, you undertake

  • to use only content and sources that you are entitled to use, and not to use the apps for unlawful purposes,
  • not to circumvent technical protection measures, whether those of the apps or those of content (such as copy protection),
  • not to decompile, disassemble or otherwise reverse engineer the apps, unless this is expressly permitted by law,
  • not to sell, rent or distribute the apps in modified form, and not to remove copyright or trademark notices.

6. Third-party content and links

Content that you retrieve via your own sources is loaded by the app directly from your provider. We do not store this content, do not select it and do not adopt it as our own.

The website and the apps contain links to third-party offerings, including publicly available channel lists in the Free TV feature. The respective operator alone is responsible for their content. As soon as we become aware of unlawful content, we will remove the link concerned without delay (§ 17 ECG). Please send notices of legal infringements to support@novaraiptv.com.

7. Warranty and liability

We develop the apps with care. However, to the extent permitted by law, we do not guarantee that the apps will always work without errors or interruptions, or that they will work with every device and every source.

To the extent permitted by law, we are not liable for damage caused by slight negligence. This limitation does not apply in cases of intent or gross negligence, nor to damage resulting from injury to life, body or health (personal injury).

Your rights as a consumer, in particular under the Austrian Consumer Protection Act (KSchG), and your statutory warranty rights remain unaffected.

We recommend backing up your playlists and settings regularly, for example with the app’s backup feature.

8. Minimum age

The apps are intended for people aged 14 and over. Anyone younger than 14 may only use the apps with the consent of their parents or legal guardians.

9. Changes to these terms

We may change these terms of use, for example when the apps, their features or the legal situation change. We publish the current version on this page; we also announce material changes in the app or on the website. If you do not agree with a change, you can stop using the apps at any time by uninstalling them.

10. Applicable law and jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-law rules of private international law. If you are a consumer, the mandatory consumer protection provisions of the country in which you have your residence or habitual abode remain unaffected.

For consumers, the statutory places of jurisdiction apply: if your residence, habitual abode or place of employment is in Austria, legal action against you can only be brought before the court in whose district one of these places is located (§ 14 KSchG). If you live in another EU member state, you can also bring legal action there and can only be sued there.

11. Language version and contact

These terms of use are available in several languages. The German version is authoritative.

Please send any questions about these terms of use to support@novaraiptv.com.
